Charges against two men implicated in Deandre Kelly’s escape from the county jail in January were not prosecuted by State’s Attorney Lisa Thayer Welch during recent Garrett County Circuit Court proceedings.

Richard Demoan Hall Jr., 27, Frederick, and Eric Mandrell Nibbins, 27, Washington, D.C., were both indicted by the March 2011 grand jury with one count of conspiracy to commit first degree escape, first degree escape, two counts of first degree assault, two counts of second degree assault, and use of a handgun in the commission of a felony/crime of violence.

Five drug-related charges against Hall were also not prosecuted by the state’s attorney: possession of a controlled dangerous substance (CDS) with intent to distribute, conspiracy to possess CDS with intent to distribute, CDS distribute with a firearm, and two counts of possession of marijuana.

The drug charges stem from a traffic stop conducted by Maryland State Police on eastbound I-68 near Friendsville on Jan. 22. Hall and Kelly were passengers in a car driven by 27-year-old Frostburg area resident Amber Lynn James, who was stopped for traveling 83 mph in a 65 mph zone.

OAKLAND — A Cumberland man who assisted Deandre Kelly after he escaped from the Garrett County Jail in January was sentenced to a three-year prison term in Garrett County Circuit Court on Wednesday.

Dionte Pierre Coley, 39, pleaded guilty to conspiracy to commit escape in the first degree and related charges were dismissed by Judge Jim Sherbin, according to the Garrett County State’s Attorney’s Office.

Criminal investigators with the Garrett County Sheriff’s Office and U.S. Marshal’s Service determined Coley was a person involved in arranging transportation away from the jail for Kelly on Jan. 23.

Coley had been indicted by the March term of the grand jury.

Kelly, 29, was taken into custody by federal authorities following his arrest May 2 in the Lynchburg, Va., area by U.S. marshals.

All six defendants charged in the escape have reportedly entered not guilty pleas.

Chiquita Annette Richardson, 27, of Alexandria, Va., was sentenced last month to four years in the Maryland Division of Correction.

The other defendants include Eric M. Nibbins, 26, of Alexandria; Amanda S. Lambert, 23, of Cumberland; Jamal Kelly, 25, and Robert Marshall Jr., 27, both of College Park; and Richard D. Hall, 26, of Frederick.

Lambert and Jamal Kelly were released on bond, pending trial. Nibbins is jailed in the Allegany County Detention Center. Marshall and Hall remain jailed in Garrett County awaiting their next court appearance, according to a spokesman for the Garrett County Sheriff’s Office.

The escape investigation was conducted by the Maryland Department of Public Safety and Correctional Services. Two employees of the detention center were terminated for violations of policy relating to the escape that occurred when Kelly reportedly displayed a handgun.

Deandre Kelly was arrested in Garrett County in a traffic stop in Friendsville on Jan. 22 after he fled from state police. At the time, he used an alias. He was treated at Garrett Memorial Hospital and escaped from jail after police learned his true identity. Kelly was wanted as a federal fugitive in the Washington, D.C., area on drug charges.

5/23/2011 — In regard to the most recent inmate escape at the Garrett County Detention Center on May 19, I would like to make the public aware of the following information regarding this matter. (“Friendsville woman flees detention center,” May 20 Times-News, Page 1A)

First and foremost this escape was by no means caused by employee error. The detention center employees acted professionally and promptly and greatly assisted in the apprehension of the suspect.

In 1998, the county received funding to build a holding facility directly adjacent to the visiting room in the Garrett County Detention Center. The funding was provided by the Department of Juvenile Services with the intention of it being used for the detainment of juveniles.

This facility has often been used for the adult inmates when the jail is overcrowded, as in this case. The holding facility was constructed with concrete cinder blocks. However, unbeknownst to me, the bathroom facilities were constructed of half-inch drywall.

(Escapee Alisa Marie) Shaffer began kicking the walls inside the bathroom (out of camera range) and was able to compromise a hole into the corner of the lobby, out of sight of corrections officers. She then turned her jail outfit inside out to hide the black and white striping and ran out of the facility. This was observed by a civilian who directly reported it to jail staff.

Within moments we had numerous on- and off-duty units from various agencies in the search, and with the assistance of information provided by the Department of Parole and Probation we were able to safely locate and return Shaffer to the facility within an hour.

This escape was caused by nothing more than poor construction and lack of a thorough final inspection at the time of its completion in 1999.

I have immediately directed that this holding facility be no longer utilized until it can be properly reconstructed.

My staff was able to locate the original holding facility plan, dated June 1, 1998, and after careful review nowhere did it indicate that any exterior walls were to be drywall.

This type of construction in a detention facility is inexcusable. The jail staff continually battles an outdated and deteriorating facility, but we will continue to make every effort to keep the facility secure for the public.

OAKLAND — A Friendsville woman who escaped from the Garrett County Detention Center Thursday afternoon was apprehended about an hour later on Fingerboard Road, the Garrett County Sheriff’s Office said.

Alisa Marie Shafer, 31, fled the facility about 4;30 p.m., “aided by a design flaw and structural failure at the facility,” the sheriff’s office said in a news release.

Deputies developed information that Shafer had been picked up by a vehicle in the area of Hutton Road. Police located the vehicle and a traffic stop was made on Fingerboard Road where Shafer was taken into custody without incident.

The sheriff’s office was assisted by Maryland State Police, Oakland Police Department, Natural Resources Police and the State’s Attorneys Office.

An investigation is ongoing by the Garrett Bureau of Investigation and additional charges are pending, police said.

Thursday’s incident marks the second time in four months that an escape has occurred from the jail. Deandre Kelly, 29, of Washington, D.C., escaped the facility on Jan. 23. He was subsequently arrested May 2 in the Lynchburg, Va., area by U.S. marshals.

— OAKLAND — Garrett County Jail escapee Deandre Kelly, who fled from the lockup in January, was arrested Monday night in Bedford, Va., by U.S. marshals, according to local law enforcement sources.

Further details of the arrest were not immediately available.

Kelly, 29, of Washington, D.C., allegedly displayed a handgun and forced correctional officers to unlock a door that allowed him to escape Jan. 23.

The search for Kelly since the escape has included the participation of the Garrett County Sheriff’s Office, the FBI, Maryland State Police, Maryland Natural Resources Police and Oakland Police.

OAKLAND — The investigation into the escape of 29-year-old Deandre Kelly from the Garrett County Detention Center in January has not yet been completed but Sheriff Rob Corley has already taken action in the case.

“Through the investigation, administrative actions were taken against two officers who were relieved of their employment at the detention center and have since been replaced,” said Corley.

The identity of the officers who were relieved of their duties has not been disclosed.

The sheriff also said that he is working with the county commissioners to improve conditions at the detention center to “create a safer working environment.” He said equipment has been upgraded and new personnel have been hired as part of the ongoing process.

The investigation into the Jan. 23 escape is being conducted by the Maryland Department of Public Safety and Correctional Services. The agency was requested to investigate the matter at the request of the sheriff.

“This case is by no means closed,” said Corley on Tuesday after announcing Kelly’s arrest.

A man wanted for escaping from a Maryland jail after threatening two correctional officers was arrested in a Bedford apartment complex on Monday, police said.

The man, Deandre Kelly, was taken into custody by the U.S. Marshal Service with help from the Bedford Police Department, said police Sgt. Mike Heller. He is 29 and from Washington, D.C., court records show.

He was found in an apartment complex in the 700 block of Blue Ridge Avenue, Heller said. He did not specify a time or whether Kelly resisted arrest.

Kelly forced his way out of the Garrett County Jail in western Maryland in January when he produced what seemed to be a gun just hours after being arrested on drug charges, the Cumberland Times-News reported, citing the Garrett County Sheriff’s Office.

— OAKLAND — Five people who allegedly aided in the escape of Deandre Kelly from the Garrett County Jail in January were indicted by a Garrett County grand jury, according to State’s Attorney Lisa Thayer Welch.

Chiquita Annette Richardson, 27, Alexandria, Va.; Eric Mandrell Nibbins, 26, Alexandria, Va.; Richard Demoan Hall, Jr., 26, Frederick; Dionte Pierre Coley, 29, Cumberland; and Robert Leslie Marshall 27, College Park, were each charged with conspiracy to commit escape, escape, two counts of first-degree assault, two counts of second-degree assault and use of a handgun in the commission of a felony/crime of violence.

The five appeared before Judge Jim Sherbin for arraignment. Each entered pleas of not guilty and bond was set at $500,000 for each defendant.

Two additional related indictments were served with summonses, as those defendants had already posted bond when they were originally arrested on warrants issued by a district court commissioner. Amanda Sue Lambert, 23, Cumberland and Jamal Antonie Kelly, 25, College Park are charged with the same seven counts.

Warrants and indictments remain outstanding for two additional people in connection with the escape, with one of those being Kelly, Welch said.

Also indicted was Timothy Daniel Wilt, 46, Kitzmiller. Wilt had previously been charged with arson and arson/fraud following an investigation by the Office of the State Fire Marshal into the fire at Wilt’s residence in May 2010.

Welch said the state has determined that Wilt should be prosecuted for an insurance fraud violation. He was arraigned by Sherbin, who set his bond at $10,000.

Grand jurors also considered other issues relating to county government operations, including:

The jurors found some dangers at the county jail, which was housing 55 inmates at the time of the report.

The two full-time and one part-time cooks are put in danger because of the location of the small kitchen.

Sheriff Rob Corley explained that the hallway deputies use to escort inmates to and from their cells passes the open entrance to the kitchen.

The jurors also pointed out what they believed to be extreme danger to sheriff’s staff as well as health care professionals who come to the facility.

“… there are areas with no cameras inside or outside,” they wrote.

“Grand jury members have great concerns about the facility, particularly as it affects the safety of the staff. The grand jury recommends that the county commissioners prioritize a new jail project through state funding sources and/or through county budget,” it was stated in the report.

Maximum inmate capacity is 65 males and 12 females. The most inmates at any one time was 93, requiring use of the juvenile holding area.

Corley said Thursday that Deandre Kelly, who escaped from the jail in January after being arrested on drug, weapons and traffic charges, remains at large.

Seven of nine of Kelly’s associates taken into custody at that time are still jailed, including one in the Allegany County Detention Center, according to Corley.

The jail staff consists of 21 full-time and three part-time employees.

Emergency Management

Jurors learned that calls from land lines and some cell phones that are made to the 911 center are displayed on a screen and that the ability exists to track cell phones that are on the move.

A new software program on the way, called WAGON, will allow dispatchers to hook emergency calls to other stations and mobile communication devices in the state’s three western counties.

This summer, dispatching in the sheriff’s office and the 911 center will be consolidated.

The county’s emergency management agency employs eight dispatchers, seven emergency medical service providers and one emergency planner.

Corley informed the jurors that his office will soon have four K-9 units.

Recently, a K-9 handler from Preston County, W.Va., was hired. Another deputy is scheduled to receive handler training this spring. Funds to replace an ill 13-year-old police dog will come from money seized from drug violators.

OAKLAND, Md. (AP) — Garrett County authorities are charging five people with conspiracy in the escape of a jail inmate.

The sheriff’s office said Thursday that two people from Alexandria, Va., two from College Park, Md., and a Cumberland man have each been charged with conspiracy to commit first-degree burglary, conspiracy to commit first-degree assault and being an accessory after the fact.

This brings to seven the number of alleged conspirators in the Jan. 23 escape of 29-year-old Deandre Kelly of Washington. He remains at large.

OAKLAND — The escape of an inmate from the Garrett County Detention Center on Jan. 23 will be formally investigated by the Maryland Department of Public Safety and Correctional Services, according to Garrett County Sheriff Rob Corley.

“I have requested the state to investigate, and I have verbal confirmation that the agency will do the investigation,” said Corley.

Deandre Kelly, 29, of Washington, D.C., escaped from the lockup after he “produced an object believed to be a handgun and forced the officers to release an exit door,” according to the sheriff’s office in a press release that announced the escape. The media received notification of the escape in the early morning hours of Jan. 24.

Two correctional officers involved in the incident were not injured. No formal action has been taken against the officers. The incident has been under investigation from the outset by the sheriff’s office. Corley indicated late last week that an independent agency was asked to become involved in the investigation. Tuesday, he told the Times-News that the DPSCS would formally investigate the escape.
